Purpose of the Surety Bond Requirement

An Arizona temporary restraining order bond is similar to an injunction surety bond, except that it is given without notice to the opposing party. The concept, however, behind this court surety bond is the same as an injunction, and both surety bonds are offered by our agency.

There is a level of urgency to a TRO surety bond that is not found with your typical injunction bond.

The purpose of the temporary restraining order bond, required by the Court of a Plaintiff on behalf of a Defendant(s), is that in case it is later determined by the Court that the temporary restraining order (known as a TRO) should not have been placed, the Defendant(s) may be compensated for the monetary loss caused by the placement of the order.

Rule 65 of Arizona Court Rules discusses both injunctions and TRO’s.




Qualifying and the Premium




Qualifying for the Arizona temporary restraining order bond includes a completion of an application--- we can and will begin the application with you over the phone; however, the completion of the surety bond application includes your signature and that of a witness (it doesn’t need to be notarized).

There is also a credit check involved. To be approved for a TRO surety bond through our agency, good credit is required. The approval is granted at 2% of the bond’s amount, with a minimum $100 premium.

Additionally, a copy of the Court Order is needed. The Court Order is needed because it establishes the bond requirement, provides the names of the parties to the case, and gives us additional information which will appear on the surety bond.

After review and approval of your TRO surety bond, the premium is taken and the bond is issued to you for filing. Included with your surety bond will be a Power of Attorney. All original documents received will be filed by you to the presiding Arizona court.




Annual Renewal of the Premium




The premium associated with your Arizona temporary restraining order bond is not a onetime payment. Rather, the premium will renew annually on the anniversary of your surety bond’s issuance for as long as the court requires bond.
