Surety Bond; Purpose




A preliminary injunction bond is a Court-ordered bond required of a Plaintiff, in the name of the Court, and on behalf of a Defendant(s) in a civil litigation proceeding.

While the bond is required of you as Plaintiff (or for legal counsel, your client), the potential beneficiary of this surety bond is the Defendant(s), if applicable.

The purpose of this surety bond is to offer financial recompense for Defendant(s) who are subsequently determined to have been wrongly enjoined; and, therefore, to compensate the Defendant(s) for the financial loss and harm as a result of such enjoining.

If the Court requires an injunction bond, the order for a preliminary injunction is predicated on the procurement of the bond.  Therefore, if surety is not obtained within the time frame the Court appoints, the preliminary injunction ceases automatically and no injunction takes place.




Qualifying and the Premium




Our agency offers you the Maryland injunction bond in the amount that the Court requires of you. Up to a $25,000 surety bond requirement, we also do so without a credit check.

A Maryland preliminary injunction bond greater than $25,000 has the additional requirement of being reviewed by an underwriter. And for these higher amounts, good credit is required.

We will not be able to approve applicants who have a requirement greater than $25,000 and who have poor business and/or personal credit.

Regardless of the amount of injunction bond required, our agency will need the following from you:

  • A copy of the Court Order. This is listed first, because it is the first thing needed. The Order, besides showing the need of a preliminary injunction bond, also provides us with information which must be included on your bond;
  • A signed and completed surety bond application. Your application will need to be both signed and witnessed, but no notary is required. We can begin the application with you by phone, filling in much of with you;
  • Upon approval of your surety bond, payment of at least the first year’s premium.

Once premium has been received, our agency issues your injunction bond immediately for filing. Included with your bond will be a Power of Attorney form.

While we sign your bond as Surety, you’ll need to sign it as Principal. It will be your responsibility to file your bond and Power of Attorney form with the Court.




Annual Renewal of the Premium




The premium connected to your Maryland preliminary injunction bond renews annually on the anniversary of your bond’s issuance. Premium paid are earned in full.

Options exist to prepay your surety bond premium up to 3 years which offers you a savings over annual renewals.
