Surety Bond; Purpose And Amount




An action of replevin allows a Plaintiff, in a civil litigation proceeding, to seize the disputed assets of a Defendant(s) prior to the court issuing a final verdict about the ownership of those assets.

As a condition of granting the replevin, the Plaintiff must secure a surety bond by order of the Court. This bond is issued on behalf of the Defendant, in the court’s name.

The purpose of the replevin surety bond is the following: In case the court subsequently determines, in light of new evidence, that no replevin order should have been issued, the Defendant(s) may be financially recompensed for the loss or harm caused as a result of the replevin order.

Arkansas Code §18-60-812 mandates that the replevin bond is no more than twice the value of the property in question and the cost of action.




Qualifying and the Premium




Our agency offers you the Arkansas replevin bond up to a $100,000 surety bond requirement without a credit inquiry; and we also offer this bond in any other amount required by the court and by statute.

Amounts greater than $100,000 require you to both complete a surety bond application and have your application reviewed by an underwriter. Good credit is required for approval at these higher amounts.

Regardless of the amount of your replevin bond requirement, our agency will need the following from you:

  • A copy of the order for the replevin bond. This order provides us with practically everything that will need to be included on your surety bond. Providing this order is crucial to issuing your surety bond;
  • A complete of a surety bond application. As noted above, your surety application will be reviewed by an underwriter for amounts greater than $100,000;
  • Upon approval of your replevin bond application, payment of the first annual premium.

After payment is received, our agency issues your surety bond and a Power of Attorney form to you immediately for filing with the court. These documents will be mailed to you (or for legal counsel, your client) for signing.

You will then file these items with the presiding court.




Annual Renewal of the Premium




The premium for your Arkansas replevin surety bond renews annually on the anniversary of its issuance. This will occur for as long as the court requires surety.

Premiums, when issued, are earned in full; no refunds, in full or in part, are offered.
