If you have been informed that you are required to obtain a court cost surety bond for the state of Colorado, you may likely be a bit confused as to why you particularly must obtain this bond.
The bond is a statutory requirement based on Article 16 § 13-16-101 of the Colorado Revised Statutes.
Fortunately, the Colorado court cost bond has a limit — $5000 — and the purchase of the bond is very low — $100, annually.
You will need to provide us with the name of the court and the court’s address for the bond’s obligee.
Court Cost Bond
The following persons who are initiating a cause of action may be required, at the request of the defendant, or the court, to obtain a Colorado court cost bond.
- A plaintiff who is a non-resident of Colorado initiating a case in Colorado. Also, if during the case you become a non-resident of the state;
- AND, whom the court believes may be unable to pay the costs related to the suit.
The purpose of this bond is to ensure that all costs to the court will be paid by you in a timely manner.
Qualifying for this Bond:
Your Colorado court cost bond is easy to qualify for. After providing us with the bond amount required, and completion of the application and payment of the premium of $250, the bond will be issued to you.
There is no credit check or underwriting for this bond.
Regardless of the amount required (and by statute, the cap is $5000) the cost to you is just a one time $250 payment.
After payment, a copy of the bond can be emailed to you by our agency at no additional charge.
The original will follow in the mail by the same or the following business day.
