By Order of the Court; Surety Bond Purpose and Amount




A Court-ordered injunction, also referred to as a preliminary injunction, is an Order on behalf of a Plaintiff which mandates that a Defendant(s) desist from some activity believed to cause harm or to be a violation of some contract or agreement.

A condition for the enactment of an injunction order is that the Plaintiff obtain a surety bond.

The surety bond serves as a financial guarantee for the Defendant(s) that should the Court subsequently determine that the injunction should not have been placed, the Defendant may be compensated for the resultant loss due to the injunction.

The amount of the injunction surety bond is left to the discretion of the presiding Colorado Court. In Colorado, Civil Procedure 65 details preliminary injunctions.

Our agency only provides injunction bonds required of Plaintiffs; we do not provide injunction surety bonds for Defendants.




Qualifying and the Premium




Qualifying for the Colorado injunction bond includes completing a short surety bond application, providing requested documents, and undergoing an underwriter review. This latter includes a credit check inquiry.

For a Colorado injunction bond up to $25,000 (this is not true, however, of Colorado temporary restraining order bonds), there are no credit check qualifications; after submission of an application and requested documents, your bond is approved.

Regardless of the amount of the injunction bond required, we’ll request the following from you:

  • A completed application. For amounts greater than $25,000, you will need to sign an application, because there will also be a credit inquiry; for lesser amounts this is not required;
  • A copy of the Court Order. The Order will provide us with a lot of the information which appears on your surety bond: Case number, parties to the case, order to obtain surety, etc.
  • Additional information as needed and requested.

To be approved for an injunction bond greater than $25,000, good credit is required.  Our agency will not be able to approve your application otherwise.

Upon approval of your surety bond application and payment of the premium, your bond is issued to you along with a Power of Attorney form.

We will sign your bond as Surety; upon receipt, you’ll sign your bond as Plaintiff, thereafter filing all completed documents to the Clerk of the Court.



Amount of Premium


We offer the Colorado injunction bond for 2% of the surety bond amount required.





Annual Renewal of Premium




The premium associated with your Colorado injunction bond is not a onetime payment, but renews annually on the anniversary of its issuance. This is for as long as the Court requires an active surety bond.
