Surety Bond; Purpose And Amount

 

In Connecticut, a writ of attachment is also formally referred to as a “prejudgment remedy”, (Connecticut Statutes Chapter 903a, Section 52-278a).

The Connecticut writ of attachment, which is also known as an attachment or plaintiff’s attachment, allows a plaintiff in a civil litigation proceeding to seize and take possession of the property held by a defendant, prejudgment.  

A condition of your writ of attachment is that you as plaintiff obtain a surety bond in the amount that the court directs and orders.

While required of the plaintiff, the writ of attachment bond is for the benefit of the defendant in case the presiding court subsequently determines that the attachment was wrongly issued.  

The defendant by means of the surety bond is thereby guaranteed the return of the property (if the attachment is determined to have been wrongfully issued) and may be compensated for the loss and harm caused by such an order.

 

Qualifying and the Premium

 

The Connecticut writ of attachment bond is offered to you up to a $100,000 surety bond requirement without a credit check inquiry.

A writ of attachment greater than $100,000 is subject to further review of your application and documents requested by a surety bond underwriter. For surety bond requirements above this amount, good credit is also required.

For any writ of attachment, our agency will need the following from you:

  • A copy of the Connecticut court order stating that a writ of attachment, attachment, or plaintiff’s attachment surety bond is required and the amount of such bond.  A replevin bond is also the same as an attachment bond;
  • A completed application by you.  We typically provide this application via Docusign which will allow you to complete, sign and return your application to us electronically;
  • Review of your application, in part, according to the dollar threshold amounts discussed above;
  • Upon approval of your application, payment of the premium.

 

Issuing Your Attachment Surety Bond

 

Our agency issues your attachment surety bond immediately upon payment of the premium.  Your surety bond, along with a Power of Attorney form document are mailed to you.

Upon receipt, you as plaintiff will sign your bond as principal, and thereafter you’ll file both documents received from our agency with the presiding Connecticut civil court.

 

Annual Renewal of the Premium

 

The premium for your Connecticut garnishment bond is subject to annual renewal of the premium on the anniversary of your bond’s issuance.

Premiums paid are earned in full and are not subject to refunds, either entirely or partly.
