The Delaware conservator bond is alternately referred to as a Delaware guardian/guardianship bond. For purposes of securing your surety bond requirement, both terms may be used interchangeably.
This conservator surety bond is required as a condition of your appointment of conservator/guardian, and guarantees to both the Delaware probate court and the person over whom you are appointed that you will act in a proper fiduciary manner over the administration of the estate.
In this regard, Delaware law, Title 12, Chapter 39, Guardian §3905 (a) mandates the procurement of a surety bond.
Also, at least one Delaware county offers a Conservator Bond form.
The probate court will determine the amount of conservator/guardian surety bond required of you.
Our agency offers you the Delaware conservator bond in the amount that the probate court requires. Up to a $100,000 surety bond requirement, we do so without a credit inquiry.
A conservator surety bond greater than $100,000 is approved based on a surety bond underwriter review of your application. Good credit will also be required for approval for an amount greater than $100,000.
In any case, regardless of the amount of surety bond required of you, our agency will need the following:
We issue your conservator bond to you immediately upon receipt of the premium payment. Included with your surety bond will be a Power of Attorney form.
Upon receipt by mail, you’ll sign your bond as Principal. You will then file your bond and POA with the presiding Delaware probate court.
The premium associated with your Delaware conservator bond renews annually for as long as the court requires surety.
Paid premiums are earned in full and are non-refundable both in whole and in part.
