Surety Bond; Purpose

The personal representative surety bond required of an estate which is in probate refers to administrators, executors, and non-Delaware residents who are appointed as such by a Delaware court.  

The surety bond required of you as a condition of your appointment serves as a financial guarantee that you will be in compliance with all probate-related Delaware laws.

The amount of the surety bond will be determined by the court, and is likely to be commensurate with the value of the underlying estate, and possibly any projected earnings the estate may have within a given time frame.

Qualifying and the Premium

Our agency offers you the Delaware personal representative bond (this bond may also be interchangeably referred to as a Delaware administrator bond) in the amount that the court requires of you.

Additionally, up to a $250,000 surety bond requirement, we also do so without a credit check.  

If you require a personal representative bond greater than $250,000, approval is subject to an underwriter review; providing any additional documentation or information requested by the surety bond underwriter; and, of course, good credit.

For any personal representative surety bond, our agency will need the following from you:

• A copy of the Delaware court order appointing you personal representative (or any related term), and which states the surety bond amount required of you;
• A completed surety bond application.  We’ll send you the application via DocuSign to facilitate ease and timeliness of completion;
• Review and approval of your personal representative application according to, in part, the dollar limits discussed above;
• Upon approval of your surety bond, payment of at least the first annual premium.

Your personal representative bond is issued to you immediately upon payment of the first annual premium.  Your bond, along with a Power of Attorney form, are issued to you for signing and filing with the Delaware court.

Annual Renewal of the Premium

The premium for your Delaware personal representative/administrator bond renews annually for as long as the court requires surety.

Premiums paid are earned in full and are non-refundable in part or in whole.
