Surety Bond; Purpose




A temporary restraining order bond is a Court-ordered surety required of a Plaintiff in a civil litigation proceeding. The issuance of the “restraining order” is predicated upon the procurement of the surety bond; and if the Court requires it, the preliminary injunction will not be issued without the furnishing of surety.

While required of the Plaintiff, this surety bond is issued on behalf of the Defendant(s). It is frequently issued ex parte, that is, without the other party being present.

The purpose of this surety bond is to serve as a financial guarantee that in case the Court subsequently determines that the restraining order should not have been issued, the Defendant(s) in the proceeding can be guaranteed financial recompense for the losses incurred as a result of the injunction.

The amount of the temporary restraining order required will be at the discretion of the presiding Court.




Qualifying and the Premium




Our agency can provide you with a Delaware temporary restraining order bond in whatever required of you; and, up to and including a $25,000 surety bond requirement, we do so without a credit check inquiry.

Regardless of the amount of surety bond you require, our agency will need the following from you:

  • A copy of the Court-order stating that a temporary restraining order bond is required. This Order also provides us with other information needed for the accurate issuance of your surety bond (i.e. the case number, the Court venue, etc.). This is the first item that we’ll need and your bond cannot be issued without it;
  • A completed surety bond application. The application is thankfully relatively short; and our agency will complete much of with you over the phone. Still, the application will require your signature and that of a Witness

Plaintiff litigants who require a TRO surety bond greater than $25,000 (even if by $1) will have their application reviewed by an underwriter. The review includes a credit check inquiry; and for approval, good and satisfactory credit are required.

We will not, unfortunately, be able to approve applicants with poor credit histories.

Upon approval of your TRO surety bond and payment of the premium, your bond documents and Power of Attorney form are issued to you for mailing and filing.

Upon receipt by mail, you as Principal will sign the bond and file it with the respective Clerk of the Court.




Annual Renewal of the Premium




The premium associated with your Delaware temporary restraining order bond is not a onetime payment. Rather, your court-bond renews annually on the anniversary of its issuance.

As a general rule, we tell clients to realistically expect to pay the premium twice: Upon the first issuance of the bond, and at least one year thereafter.
