Surety Bond; Amount and Purpose


A Florida writ of attachment bond allows you as plaintiff to seize the defined assets of a defendant in a civil litigation proceeding, prejudgment.

According to Florida Statute §76.12, as amended, in order to do so, you are required to obtain a surety bond that is twice the value of the property or assets to be seized.

While you as plaintiff (or for legal counsel, your client) are required to obtain an attachment surety bond, its benefit is for the adverse party in case the court subsequently rules in their favor.  

The harm and damage already done in such a determination, the surety bond is a financial guarantee of the defendant’s recompense for such damage and loss.

This surety bond is also referred to as a ‘plaintiff’s attachment bond’ or an ‘attachment bond’.


Qualifying and the Premium


The Florida writ of attachment bond is offered to you up to a $100,000 surety bond requirement without a credit check inquiry.  

An attachment bond requirement greater than $100,000 is subject to further review of your application by a surety bond underwriter.  This review would include a credit check inquiry.  To be approved, good credit will be required.

For any attachment surety bond, regardless of the amount, our agency will need the following from you:

  • A copy of the Florida court order stating that an attachment surety bond is required and which states the amount;
  • A completed application from you.  The application is typically sent to you via Docusign. This will allow you to complete, sign, and return the application to our agency electronically;
  • Review of your completed surety bond application, according to, in part, the amount required of you as discussed above;
  • Upon approval of your application, payment of the premium.


Issuance of Your Writ of Attachment Bond; Filing


Our agency issues your Fl writ of attachment surety bond immediately upon payment of the premium.

Your surety bond and a Power of Attorney are then mailed to you for signing and filing as Principal.

Our experience with Florida courts is that these court-ordered surety bonds may be uploaded by your legal counsel and filed electronically; however, you’ll still want to make sure that this is applicable for your case.

If so, we can provide the bond to you via email.  After you, as plaintiff, sign your surety bond as Principal, your bond can then be filed electronically by your legal counsel.


Annual Renewal of the Premium


This writ of attachment bond is subject to annual renewals on the anniversary of your bond’s issuance for as long as the court requires surety.

Premiums paid are earned in full and are not subject to refunding either in whole or in part.
