Surety Bond; Purpose and Amount 




As a court appointed conservator, you are tasked with an important fiduciary responsibility. 

Thus, as a condition of your conservatorship appointment over a minor or an incapacitated adult, the court requires you to obtain a surety bond in the amount that the court orders.

Your surety bond requirement serves as a financial guarantee to the court and to the estate over which you’ve been appointed, that you will perform your duties in accordance with Georgia law and the directives of the court. 

While the Georgia Probate Code, Section 29-5-40, as amended, only states that surety is required, the amount will likely be commensurate with the assets over which you’ll have immediate control.

For our purposes, this surety bond may also be referred to as a Georgia guardian bond.




Qualifying and the Premium




Our agency offers you the Georgia conservator bond in whatever amount that the court has ordered of you.  Up to a $100,000 surety bond requirement, we also do so without a credit check.

If you require a surety bond greater than $100,000, approval is after a review of your surety bond application by a surety underwriter.  This review includes a credit check inquiry; good credit is required for approval.

Additionally, at these higher amounts, approval is conditioned upon supplying any additional information or documentation requested. 

Regardless of the amount of your GA conservatorship bond, our agency will need the following from you:

  • A copy of the Georgia court order which states that you’re required to obtain a conservatorship surety bond;
  • A completed surety bond application.  This application may be sent to you via DocuSign to facilitate ease of completing;
  • Review of your completed surety bond application;
  • Upon approval of your conservatorship bond, payment of the first annual premium.

Immediately upon receipt of the premium, our agency issues your surety bond and a Power of Attorney form, both of which you file with the court upon receipt by mail (you’ll need to sign your bond as Principal).




Annual Renewal of the Premium




The premium for your Georgia conservator/guardian bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.

Premiums paid are earned in full and are completely non-refundable.
