Surety Bond; Purpose




Probate may be defined as the process of proving a will; and this is too, also, of those who die intestate, that is, without having left a will.

In Georgia, Title 53, Chapter 6 of the state's legislation, mandates that a surety bond is obtained as a condition of appointment to oversee the estate.

The Georgia probate bond may be required of those who are titled as:

  • Personal Representatives;
  • Administrators;
  • Executors;
  • Conservators;
  • Or trustees of an estate.

The probate surety bond requirement is a financial guarantee that you will faithfully carry out the duties as an administrator of the estate over which you have been appointed.




Qualifying and the Premium




Our agency provides the Georgia probate bond in any amount required. For those who require a probate surety bond up to, and inclusive of, a $250,000 requirement, we also do so without a credit check inquiry.

A surety bond requirement greater than $250,000, if required, will review of your surety bond application by a surety underwriter. This review includes a credit check inquiry.

For these higher amounts, to be approved good credit is required. You may also be asked to provide the name of the attorney overseeing your case.

Regardless of the amount of your Georgia probate surety bond requirement, our agency will request the following from you:

  • A copy of the court order or minutes mandating the surety bond requirement;
  • In some cases, we’ll need a signed surety bond application. To facilitate meeting this requirement, the application can be sent to you via DocuSign. In other cases, we may waive the application requirement altogether. A surety bond requirement over $250,000 will always require a signed application;
  • Review of your surety bond application as indicated above;
  • Upon approval of your application, payment of at least the first annual premium.




After Payment of the Premium




Once the premium for your Georgia probate bond has been paid, our agency issues your surety bond and a Power of Attorney form for you.

We will sign your bond as Surety; upon receipt by mail of your bond documents, you will sign them as Principal.

Thereafter, you’ll file both completed surety bond documents with the court; our agency will not need a copy of these documents.




Annual Renewal of Your Probate Surety Bond Premium




The premium associated with your Georgia probate bond renews annually for as long as the probate court requires surety. Your probate bond will renew on the anniversary of its issuance.

Options exist to prepay your surety bond premium up to 2 or 3 years; however, should probate be settled within the interim, our agency will not offer you any premium refunds.
