Surety Bond; Purpose




A Georgia “replevin action” or “writ of possession” (the two terms mean the same) occurs in a civil litigation proceeding where the court allows the Plaintiff to seize and take possession of the property of the Defendant(s) before a final judgment is given in the underlying case.

As a condition of granting the replevin action, the court will require a surety bond of the Plaintiff.

The bond, while obtained by the Plaintiff, is on behalf of the Defendant in case the court subsequently determines that the replevin action issues should not have been, in light of information that later comes to light.

In such a determination, the surety bond acts as a financial guarantee that the Defendant will be able to be compensated for the loss and harm caused as a result of the issuance of the replevin.

However, according to Georgia Code Title 44, Chapter 12, § 44-12-171, the Defendant is allowed to recover the property instead of making a claim against the surety bond.




Qualifying and the Premium




Our surety bond agency offers the Georgia replevin bond in any amount required by your presiding court.

To streamline the process of issuing your surety bond, up to a $100,000 surety bond requirement, we also do so without a credit check inquiry.

Amounts greater than $100,000, require an application review by a surety bond underwriter. This review includes a credit check inquiry. Approval for these higher amounts is based on the determination of good credit, and, depending on the amount required, additional factors.

Regardless of the amount required, however, our agency will need the following from you:

  • A copy of the writ of possession or replevin court order which states the surety bond requirement;
  • A completed surety bond application;
  • Upon approval of your replevin surety bond, payment of at least the first annual premium.




Approval and Issuance




After your replevin bond application has been approved and the first annual premium paid, our agency issues your bond to you immediately for filing.

We will sign your bond as surety; and you, upon receipt by mail, will sign your bond as Principal and then file it with the presiding court.

Included with your surety bond will be a Power of Attorney form which you’ll also need to file.




Annual Renewal of Your GA  Replevin Surety Bond Premium




The premium associated with the Georgia replevin bond renews annually for as long as the court requires surety. Renewal will be on the anniversary of your bond’s issuance.

Premiums paid are earned in full and are not refunded, in full or part, should the case be resolved within the bond term.
