An action of replevin is alternately, though less commonly, referred to as a sequestration bond or writ of attachment bond.
An action of replevin occurs when a Plaintiff is allowed by the presiding court in a civil litigation proceeding to seize and take possession of the property of a Defendant(s) before a final judgment is given in the underlying case.
As a condition of granting the replevin action, the court will require the Plaintiff to obtain a surety bond in the amount that the court indicates.
While the Plaintiff has the surety requirement, the benefit of the bond is on behalf of the Defendant in case the court subsequently determines that the issuance of an action of replevin was wrong.
If such were the determination of the court, the Defendant may be recompensed for the loss, harm, and damages, caused by the issuance of the wrongful replevin action.
Qualifying and the Premium
Our agency offers you the Hawaii replevin surety bond in the amount that the court requires of you as Plaintiff (or for legal counsel, your client).
Applicants who require a surety bond up to and inclusive of a $50,000 amount will be approved without a credit inquiry; and for those who require a greater amount, upon approval of your good credit.
Regardless of the amount of your replevin surety bond requirement, our agency will need the following from you:
- A copy of the court order or minutes stating that a replevin, sequestration, or writ of attachment bond is required. This order provides us with practically all, if not in fact all, of the information to be included on your surety bond;
- A completed surety bond application which may be sent to you by DocuSign;
- A review of your application — above $50,000 by a surety bond underwriter, to include a credit check inquiry; for smaller amounts, review without a credit check inquiry;
- Payment of the first annual premium.
Issuance of Your HI Replevin Bond
Upon receipt of the premium for your surety bond, our agency issues your bond and an accompanying Power of Attorney form for you to file.
We will sign your bond as Surety; upon receipt, you’ll sign your bond as Principal. You will then file all both the surety bond and POA form with the presiding court. Our agency will not need a copy of your signed bond.
Annual Renewal of the Premium
The premium for your injunction bond renews annually on the anniversary of its issuance for as long as the court requires surety.
