Surety Bond; Purpose




If you’re reading this, it is likely that you have been given an Idaho court-appointed position as a “personal representative” over a decedent’s estate.

A condition of your appointment is that you obtain a surety bond in an amount that the Idaho court has directed.  

In Idaho, this probate surety bond is required, in part, pursuant to the state's legislation, Section 15-3-605, as amended, which states that a person who is an heir or credit of the estate in an amount of $1000 or more may require that bond be given.  

Your personal representative bond is likely much higher than $1,000; and it is likely commensurate with the value of the estate and any future earnings the estate may expect to earn.

This surety bond serves as a financial guarantee for the court, heirs, and any creditors, that you will observe all Idaho laws and regulations in the administration of the estate.  

This surety bond may alternately be referred to as an Idaho administrator bond.  




Qualifying and the Premium




Our agency offers the Idaho personal representative bond in any amount.  

If you require a personal representative bond up to $250,000, we can issue this for you without a credit check inquiry.  Higher amounts are determined based on an underwriter review of your application, and the determination of your good credit.

For any administrator/personal representative bond in Idaho, our agency will need the following from you:

  • A copy of the Idaho court order appointing you personal representative or some other related term (executor, administrator, etc.) and stating the surety bond amount required of you;
  • A completed surety bond application.  The application can be sent to you via DocuSign.  This facilitates ease of completion;
  • Review of your completed application, in part, according to the dollar amount required of you;
  • Upon approval of your surety bond, payment of the first annual premium.

Your surety bond and a Power of Attorney form are issued to you immediately after payment of the premium.  These items will be mailed to you.

Upon receipt, you’ll sign your bond as Principal and then you’ll file your completed surety bond and POA with the presiding Idaho court.




Annual Renewal of the Personal Representative Bond Premium




The premium associated with your Idaho personal representative bond is not a one time payment.

The premium renews annually on the anniversary of your bond’s issuance for as long as the court requires surety. 

Premiums earned are paid in full, and are non-refundable, either in whole or in part.
