Surety Bond; Purpose
As a court-appointed receiver, you are tasked with important fiduciary and financial responsibilities. On your shoulders rests the management of a business that is in dissolution or reorganization.
To ensure that you will follow all laws and court-directives, Idaho statutes 30-29-1432, mandates that you obtain a surety bond in the amount that the court directs.
The surety bond also serves as a financial guarantee that protects the court and any other interested parties; there is no preset amount of surety bond required.
Qualifying and the Premium
Our agency approves you for the Idaho receiver bond up to a $250,000 requirement without a credit check inquiry.
For a surety bond requirement greater than $250,000, if applicable, there is a further surety underwriter review of your surety bond application. This review includes a credit check inquiry. To be approved for these higher amounts, good credit is required.
Regardless of your surety bond requirement, our agency will need the following from you:
- A copy of the court order, or the court minutes, stating that a receiver surety bond is required;
- A signed and completed application. To facilitate ease of completion of the application, it may be completed by DocuSign;
- Upon approval of your application, payment of the first annual premium. Your bond, again, is automatically approved for amounts up to $250,000; and, for a larger amount, upon determination of good credit.
Upon approval of your surety bond application, and payment of the premium, your bond and a Power of Attorney form are issued to you for filing.
Our agency signs your bond as Surety; you will sign bond as Principal. You will thereafter file your bond and Power of Attorney form with the respective court.
Annual Renewal of Your Premium
Your Idaho receiver bond premium renews annually for as long as the court requires surety. Premiums when paid are earned in full.
