Replevin Surety Bond; Purpose




An action of replevin, or writ of possession/attachment, occurs in a civil litigation proceeding wherein the Plaintiff is allowed by the court to seize the property of the Defendant before the final judgment takes place in the underlying case.

In Idaho, an order for a replevin surety bond is statutorily mandated under Title 5, Chapter 2, 5-218, as amended.

It will ultimately be at the discretion of the presiding court to determine the amount of surety bond required of you (or, for legal counsel, your client).




Qualifying and the Premium




Our agency offers you the Idaho replevin bond without a credit check inquiry for any amount up to and including a $50,000 surety bond requirement.

Surety bond amounts greater than $50,000 are approved based upon a surety bond underwriter review and a credit check inquiry. For these higher amounts, good credit will be required for approval.

Regardless of the amount of your replevin surety bond requirement, our agency will need the following from you to issue your bond:

  • A copy of the court order or minutes which names you (or your client) as Principal, and states the bond amount required. This order is crucial because it provides us with practically everything that will need to be included on your bond;
  • A completed application. To facilitate timely completion of your application, it can be sent to you by DocuSign;
  • Review and approval, subject to the surety bond amounts listed above;
  • Upon approval, payment of at least the first annual premium.

Once the premium has been received, our agency issues your surety bond and a Power of Attorney form to you for signing and filing.

We will sign your bond as Surety; you (or your client) will sign the bond as Principal. It will then be up to you file the bond and POA form with the presiding court.




Annual Renewal of the Premium




The premium associated with your Idaho replevin surety bond renews annually for as long as the court requires surety. Premiums, when paid, are earned in full and no refund, either in full or prorated, are offered should your case resolve itself within the term.
