Surety Bond; Amount and Purpose




As an Illinois court-appointed guardian, your duties include the administration of the estate of a minor, or an incapacitated adult.

A condition of your appointment is that, in accordance with the Illinois court order, you obtain a guardian surety bond.

According to Illinois law, the amount of the surety bond should be set at 1 ½ times the value of the personal estate (Letter M, “Oaths and Bonds”).

While required as a condition of your appointment as guardian, the surety bond serves as a financial guarantee for the court and the person over whom you have been appointed guardian, that you’ll be in compliance with all Illinois laws governing the administration of an estate as guardian.

For purposes of meeting the surety bond requirement, this bond may also be referred to as an Illinois conservator/conservatorship bond.




Qualifying and the Premium




Our agency offers you the Illinois guardianship bond up to a $100,000 surety bond requirement without a prior credit check.

If you require a conservatorship/guardianship bond greater than $100,000, approval is subject to review by a surety bond underwriter.  This review includes a credit check inquiry.  Additionally, you may also be asked to provide supporting information or documentation as part of the underwriting process.

For a guardianship bond amount greater than $100,000, good credit will also be required for approval.  

Regardless of the amount of your Illinois conservator/guardian bond, our agency will need the following from you:

  • A copy of the court order appointing you as conservator/guardian, and mandating the surety bond requirement;
  • A completed surety bond application.  The application can be sent to you via DocuSign.  This will facilitate ease of completing the application.
  • Review of your completed surety bond application according to, in part, the amount required of you;
  • Upon approval of your surety bond, payment of the first annual premium.



Issuing Your Guardianship Bond and Its Filing




Our agency issues your conservator/guardianship bond immediately upon payment of at least the first annual premium.  Included with your surety bond will be a Power of Attorney form.  This form gives us the authorization to issue your bond.

You will sign your bond as Principal, and, you will thereafter file your completed surety bond and the POA form with the presiding court. 




Annual Renewal of the Premium




The premium associated with your guardianship bond renews annually for as long as the court requires surety.  The anniversary of your bond’s issuance is the due date.

Premiums paid are earned in full and are non-refundable both in whole or in part.
