Indiana Action of Replevin; Surety Bond and Purpose
An replevin action takes place in a civil litigation proceeding. The Plaintiff, permitted by order of the presiding court, is allowed to seize or take possession of the disputed property of the Defendant(s).
The feature of this action which is unique is that the seizing of the Defendant’s property takes place before a final judgment is rendered in the underlying case. The action is also sometimes referred to as a writ of possession.
As a condition of granting the replevin order, the court will require you as the Plaintiff to obtain a surety bond.
Indiana Code 32-35-2-21 indicates that the amount of the surety bond will be in an amount that is the value of the property, as determined by the court; it may not, however, be less than the value of the property.
Why is a replevin surety bond required?
In case the court subsequently determines, in light of new evidence, that no action of replevin should have been issued, the Defendant may be financially compensated for the loss and harm caused as a result of the issuance of the replevin order.
Qualifying and the Premium

- If the surety bond amount required is greater than $50,000, a review by a surety bond underwriter and subject to approval on your good credit;
- After approval of your replevin surety bond, payment of at least the first annual premium.
Once your surety bond is approved and the payment made, our agency issues your bond to you immediately.
You will then be sent your surety bond and a Power of Attorney form for signing. Once received in the mail and completed, you will file both documents with the presiding court, thereby meeting this requirement.
Annual Renewal of Your IN Replevin Premium
The premium paid for your Indiana replevin bond renews annually on the anniversary of its issuance for as long as the court requires surety.
Premiums paid are earned in full, even if your bond is exonerated within or before the term.
