TRO Surety Bond & Purpose




An Indiana temporary restraining order is a preliminary injunction that is given in connection with a civil litigation proceeding.

The order is sometimes given ex parte, that is, outside of the presence of the opposing or adverse party (i.e. the Defendant(s)).

As a prerequisite to obtaining the temporary restraining order (TRO), the Court will require a surety bond. This surety bond, required of the Plaintiff on behalf of the Defendant, protects the latter party in case the Court subsequently determines that the order should not have been issued.

Due to the resultant harm caused by the issuance of the TRO, wrongly issue, and only determined later, the Defendant(s) has a financial guarantee of compensation for the financial loss caused. This is pursuant to Rule 65 (c), as amended, for the Indiana Code of Civil Procedure.




Qualifying and the Premium




Our agency offers you the Indiana temporary restraining order bond in any amount required; and for those who require a surety bond up to and inclusive of a $25,000 surety bond amount, we also do so without a credit check inquiry.

Regardless of the amount of your Indiana TRO bond, our agency will need all of the following from you:

  • A copy of the Court Order that states that an IN TRO surety bond is required. Besides providing our agency with this amount, the Court-order will have other useful information which must also be included on your surety bond for validity;
  • A completed surety bond application. The application is short enough, and we’ll begin it with you by phone; however, you’ll need to sign and have witnessed the application.
  • For a TRO bond greater than $25,000, your application is reviewed by an underwriter. This review includes a credit check inquiry, and depending on the size of the bond required, additional information.

To be approved, good credit is required for amounts greater than $25,000; we will not be able to get your application approved otherwise.

Upon approval of your surety bond and payment of at least the first annual premium, our agency issues your bond and a Power of Attorney form to you.

We’ll sign your bond as Surety; and you will sign it as Principal. You will then file your completed surety bond paperwork to the Clerk of the Court.




Annual Renewal of the Premium




The premium associated with your Indiana TRO bond renews annually on the anniversary of its issuance for as long as the Court requires surety.

Options exist to prepay your bond’s premium up to 3 years; however, should your case resolve itself within the term of your bond, no prorating or refunding of any premium is offered.
