Court Injunction; Restraining Order
An injunction surety bond is a type of court-mandated surety bond. The surety bond is required of a Plaintiff, on behalf of a Defendant(s), in case it is subsequently determined by the court that the Plaintiff’s cause of action against the Defendant was, in fact, without merit.
The bond allows the Defendant to recoup any losses that may have occurred owing to the Plaintiff’s cause of action in a court.
The bond is also customarily referred to as a “temporary restraining order bond”.
Kansas Statute Relating to Court Injunctions
Kansas statutes which refer to the temporary restraining order and the surety bond required include Chapter 60, §60-905 Temporary injunction.
The statute refers to the fact that with the exception of the state or any state agencies, the bond is required to secure damages of an injured party (i.e. the defendant) including attorney fees if such is subsequently judged by the court.
Qualifying and the Premium
Up to $25,000 surety bond, our agency provides you with the Kansas injunction bond immediately and without a credit check.
Subject to a minimum premium of $200, the bond is 2% of the amount required.
To obtain this bond, we’ll need the following:
- A copy of the court order stating the amount of the injunction bond required;
- A completed, signed and witnessed application which we’ll begin;
- Payment of the premium.
For amounts greater than $25,000, qualifying is as above; however, there is also a standard credit check involved.
Two things to note about the greater surety bond amounts: An applicant will need good credit to qualify; and the premium is 2% of the amount of the surety.
Once the premium has been paid to our agency, we issue the bond to you immediately for filing. The bond is mailed by the following business day. Your injunction bond will have our signature as Surety, and you will sign as Principal before filing with your respective Court.
Annual Renewal of the Premium; Prepayment Options
The premium for your Kansas injunction surety bond is not a onetime payment, but renews annually of the bond’s issuance.
Options exist to prepay your bond for up to 3 years, thereby saving you over annual renewals. However, no refund is offered if the underlying case is solved and your injunction bond is exonerated before the end of your premium payment period.
In other words, premiums paid are fully earned at the time of payment.
