Surety Bond; Amount and Purpose



In Kansas, a personal representative includes a court-appointed administrator, administrator with will annexed, executor, conservator or guardian.

As a condition of your appointment as a personal representative, the court requires you to obtain a surety bond. 

According to Kansas Office of Revisor of Statutes, 59-110, as amended, the amount of surety bond required will not be less than 125% of the value of the personal property and the value of the likely income that will come into your possession during the administration period.




Qualifying and the Premium




Our agency qualifies you for the Kansas personal representative bond in any amount.  

With the exception of the surety bond required of guardians/conservators, up to a $250,000 surety bond requirement, we approve you for this surety bond without a credit check inquiry. 

If you require a personal representative bond greater than $250,000, approval is subject to review by a surety bond underwriter. 

 This review includes a credit check inquiry.  To be approved, good credit will be required.

You may also be asked to provide additional underwriting information and documentation.

Regardless of the amount of your surety bond, our agency will request the following from you:

  • A copy of the Kansas court order appointing you as personal representative (or any of the related titles mentioned previously);
  • A completed surety bond application which may be sent to you via DocuSign.  This will facilitate ease of completing.  The application will be submitted electronically to our surety underwriters;
  • Upon approval of your surety bond, payment of the first annual premium.

Our agency issues your bond to you immediately.  Included with your surety bond will be a Power of Attorney form.  

Upon receipt by mail, you’ll sign and file your surety bond and Power of Attorney with the presiding Kansas probate clerk.




Annual Renewal of the Premium




The premium associated with your Kanas personal representative bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.

Once a premium is paid, it is fully earned and is non-refundable, either in whole or in part.
