Preliminary Injunction and Purpose of The Surety Bond Requirement




A preliminary injunction bond is required of a Plaintiff in a civil litigation proceeding, when ordered by the Court.

While the injunction bond is required of the Plaintiff, its benefit is for the Defendant(s), and is a prerequisite for the issuance of the preliminary injunction. The surety bond, however, is issued payable to the presiding Court.

The purpose of Louisiana injunction bond is that if the Court subsequently determines, in light of additional evidence, that a preliminary injunction should not have been issued, the Defendant may be compensated for the loss and harm caused as a result of the issuance of an injunction.

When an injunction surety bond is ordered, it must be obtained within the time period the court mandates; otherwise, the order for a preliminary injunction ceases.




Qualifying and the Premium




Our agency provides the Louisiana injunction bond in the amount required; and also, up to a $25,000 surety bond requirement, we do so without a credit check inquiry.

Injunction surety bonds greater than $25,000, have an application that is submitted to an underwriter for review. A credit check inquiry is also standard. Satisfactory credit is required for approval.

Regardless of the amount of surety required, our agency will need the following from you:

  • A copy of the Court Order. This order will tell us the amount of surety required, as also other pieces of information which will be included on your Surety bond;
  • A completed and signed surety bond application. We can begin the application with you by phone; however, again, it requires your signature (and that of a witness). This is whether or not your application needs to be submitted to our underwriters for review.
  • Payment of the premium;
  • Additional information as requested.

Once your Louisiana preliminary injunction bond is approved and the premium paid, our agency issues your bond to you immediately for filing.

We will sign your bond as Surety; upon receipt by mail, you’ll sign it as Principal. Along with your surety bond will be a Power of Attorney form.

It will be up to you to file all completed documents with the Court.




Annual Renewal of the Premium




The premium for your injunction bond renews annually for as long as the Court requires surety. Premiums may be prepaid for 2 or 3 years which offers you a savings over annual renewals.

However, premiums paid are earned in full regardless of how long Surety is required.
