Probate Surety Bond; Purpose




In Maine, a personal representative appointed to oversee an estate in probate may be required to furnish a bond if the estate is valued over $5000, or if there are debts owed in the estate exceeding $5000.

This is as per Maine statutes Title 18-C, §3-605, as amended.

The surety bond required of you as a personal representative serves as financial guarantee that you will be in compliance with all relevant Maine laws and statutes, as also any directives of the court. 

A personal representative surety bond form used by the state of Maine is also provided; or, we will use our own standard form.




Qualifying and the Premium




Our agency underwrites the Maine personal representative surety bond up to a $250,000 requirement without a credit check inquiry.

If your personal representative bond is greater than $250,000, your application is reviewed by a surety bond underwriter.  The review includes a credit check inquiry.  To be approved, good credit is required.

For a personal representative bond of any size, our agency will need the following from you:

  • A copy of the court order appointing you as Personal Representative.  This order will provide our agency with everything needed for an accurate probate surety bond;
  • A completed surety bond application.  The application can be sent to you via DocuSign;
  • Review, approval, and payment of the premium once the application has been completed.

Once your surety bond premium is paid, our agency issues your bond to you immediately.  Included with your personal representative bond will be a Power of Attorney form.  It will be your responsibility to file both documents with the Maine probate court. 




Annual Renewal of the Premium




The premium for your personal representative bond is not a single payment; instead, your bond’s premium renews annually on the anniversary of its issuance for as long as the court requires surety.

Premiums paid are earned in full and are nonrefundable both in part and in whole.
