Plaintiff Actions; Amount and Purpose


A Maine writ of attachment bond is also referred to as a Maine “attachment bond” and sometimes a replevin surety bond.

When required in Maine civil cases, the surety bond is ordered pursuant to Maine Revised Statutes Title 14, §4301.  

Your writ of attachment bond allows you as a Maine plaintiff to seize the disputed property of the defendant, prior to a final court order in your case.

But your attachment surety bond is also a financial guarantee that if at the conclusion of your case, you are required to return the seized property of the defendant, you will restore the property seized in good order; and that you will be responsible for any damages caused to the opposing party.

The court will set the amount of the attachment surety bond required of you. 


Qualifying and the Premium


Our agency offers you the Maine writ of attachment in amount.  

As Plaintiff, if you require a writ of attachment bond up to a $100,000 surety bond requirement, we also do so typically without a credit check.

An attachment surety bond greater than $100,000 is subject to further review by a surety bond underwriter.  This review will include a credit check inquiry. And, to be approved, good credit will be required.

You may also be asked to provide supporting documentation or information.

The following procedures are used to issue your attachment bond:

  • Our agency needs a copy of the Maine court order stating that an attachment surety bond is required and the amount required;
  • Upon receipt of the court order, we provide you with a surety bond application.  The application may be sent to you via DocuSign. DocuSign will allow you to complete, sign, and return the application to our agency electronically;
  • Review of your completed application by our agency or by a surety bond underwriter;
  • Upon approval, payment of the premium.


Issuing Your Bond

Your writ of attachment bond is issued to you upon payment of the premium.  Included with this bond will be a Power of Attorney form.

Upon receipt by mail, you as Plaintiff will sign your bond as Principal, filing it with the presiding civil court in your case.

Our agency does not need a signed copy of your completed surety bond.




Premiums paid for your attachment bond renew annually for as long as the court requires surety and are earned in full.
