Maryland TRO Surety Bond; Purpose




A temporary restraining order bond is a type of injunction bond. But we must define both terms. An injunction refers to a legal order that prevents someone from acting in a certain capacity (i.e. business activity).

When a temporary restraining order is issued, it is sometimes done ex parte, that is, apart from the adverse party (i.e. the Defendant(s)), which is to say that the order is issued outside of their presence.

A Maryland temporary restraining order bond is required of a Plaintiff by order of the Court. The bond is issued on behalf of the Defendant(s) in case it is subsequently determined (after facts are learned at later date) by the court that the temporary restraining order (TRO) should not have been issued.

The existence of the surety bond allows for the harmed or aggrieved party(ies), the Defendant(s) to be financially compensated or recompensed for the loss and harm caused as a result of the TRO.

In Maryland, if you (or your client) are ordered to obtain a TRO surety bond, you may be handed a copy of this form, known as a [Maryland] Temporary Restraining in Replevin Or Distraint form.




Qualifying and the Premium




Our agency provides the Maryland temporary restraining that the Court requires of you. The amount required is at the Court’s discretion.

Up to a $25,000 requirement, we also provide this court-bond without a credit check; amounts greater than $25,000 require review by an underwriter.

For these larger amounts, good credit is also required to be approved.

Regardless of the surety bond requirement, our agency will need the following from you:

  • A copy of the Court order which mandates the TRO bond. This order also provides us with other needed information needed to issue your surety bond;
  • A completed surety bond application. The application is relatively short, thankfully. But it will need to be completed and signed by the Principal. There will also need to be witness to the application, although the application does not need to be notarized;
  • Review and approval of your application for bonds greater than $25,000. Again, good credit is required.  If the amount of surety is extraordinarily large, you may be asked to provide business financial statements.
  • Payment of at least the first year premium. Premiums paid are always earned in full.

Once your MD TRO surety bond is approved and the premium paid, our agency issues your bond and a Power of Attorney form to you.

We will sign your bond as Surety; you (or for legal counsel, your client) will sign as Principal. It will be up to the Principal to file the bond with the court as ordered.




Annual Renewal of Premium




The premium that you’ll pay for the Maryland temporary restraining order bond renews annually for as long as the court requires surety.

Options exist to prepay your bond’s premium up to 3 years, which offers you a savings over annual renewals (each year prepaid offers a greater savings).

Premium paid, however, are earned in full even if your bond should be exonerated by the Court before the end of the bond term.
