Surety Bond of Personal Representative; Purpose and Amount
With the exceptions listed in Massachusetts Legislative Code Section 3-603, as amended, a condition of your probate court-appointment as a personal representative is that you obtain a surety bond in the amount that the court orders.
The personal representative surety bond, while required of you as a condition of your appointment, serves as a financial guarantee of your compliance with all Commonwealth laws. The surety bond is for the benefit of any heirs or creditors who may be harmed by your unlawful administration of an estate in probate.
This surety bond may also be referred to as a Massachusetts administrator/executor surety bond.
Qualifying and the Premium
Our agency offers you the Massachusetts personal representative bond up to a $250,000 surety bond requirement without a credit check.
Approval of a personal representative surety bond greater than $250,000, is subject to review of your application by a surety bond underwriter. You may also be asked to provide supporting information or documentation. Also, you must have good credit.
For any Massachusetts personal representative/administrator bond, our agency will need the following from you:
- A copy of the Massachusetts probate court order stating that a surety bond is required and the amount required of you;
- Completion of a surety bond application. The application can be sent to you via DocuSign. This allows you to complete, sign, and return your application to our surety bond underwriters electronically;
- Review of your completed application.
Upon approval of your surety bond application and payment of the premium, your bond is issued to you immediately. Included with your surety bond will be a Power of Attorney form.
Once received by mail, you’ll sign your bond as Principal, and thereafter you’ll file it and the POA form received to the presiding Massachusetts probate court.
Annual Renewal of the Premium
The premium associated with your Massachusetts personal representative bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are nonrefundable, either in part or in whole.
