MA TRO Surety Bond; Purpose




A temporary restraining order surety bond is a type of injunction bond required of a Plaintiff in a civil court proceeding.

The surety bond is frequently issued ex parte; all that means is that the bond is (sometimes) ordered by the Court outside of the presence of the adverse party (that is, the Defendant(s)).

While required of the Plaintiff, this bond is for the benefit of the Defendant(s) in a civil legal proceeding in case it is subsequently determined by the Court that no temporary restraining order (also known as TRO) should have been issued.

The existence of the TRO surety bond allows the aggrieved party to be compensated for the loss and financial harm caused for the subsequently-determined wrongful issuance of a temporary restraining order.

Massachusetts Revised Civil Code, Part 65 discusses temporary restraining orders, specifically.




Qualifying and the Premium




Our agency can provide the Massachusetts temporary restraining order in the amount required of the Court. Up to a $25,000 surety requirement, we also do so without a credit check inquiry.

Amounts greater than $25,000 require review by a surety bond underwriter, and if requested, additional documentation. There is also a credit check inquiry. And to be approved for these higher amounts through our agency, good credit is required.

Regardless of the amount of your MA TRO bond, our agency will need the following from you:

  • A completed surety bond application. The application will need to be signed, witnessed and returned to our agency for review;
  • A copy of the Court document wherein the order for a TRO bond is stated. Our agency requires this document because, in addition to the order itself, additional information needed for issuance of your surety bond is provided on the Order;
  • Payment of the premium.

Upon approval of your TRO surety bond and payment of the premium, our agency issues your bond to you immediately.

We will sign your bond as Surety; you will sign the original received in the mail as Principal. You will file all documents, including the Power of Attorney form with the respective Court.




Annual Renewal of the Premium




The premium associated with your Massachusetts temporary restraining order bond is not a onetime payment, but renews annually for as long as the Court requires surety.

Options exist to prepay your bond’s premium up to 3 years, which offers you a savings over annual renewals; however, premiums paid are earned in full, even if your bond is exonerated in the interim.
