Preliminary Injunction Bond; Purpose
A preliminary injunction bond is a surety bond required of a Plaintiff in a civil court proceeding. The surety bond requirement in Michigan is pursuant to Rule 3.310 (D) (4), and, when required, is a prerequisite to formalizing the injunction order.
But, what is an injunction bond? While this surety bond is required of the Plaintiff by order of the Court, its benefit is for the Defendant(s) in a litigation proceeding.
Since an injunction prevents the Defendant(s) from acting in some capacity, the surety bond acts as a financial guarantee that should the Court subsequently determine (based on evidence that comes to bear at a later date) that an injunction should not, in fact, have been issued, the Defendant is able to be recompensed for the financial loss and harm caused as a consequence of the issuance of the injunction.
Qualifying and the Premium
Our agency is able to provide you with the Michigan injunction bond in whatever amount required by the presiding court.
Up to and inclusive of a $25,000 surety bond requirement, we also do so without a credit check inquiry. For these smaller amounts, this allows for quicker issuance of your bond.
For a Michigan preliminary injunction bond greater than $25,000, a credit inquiry and review by a surety bond underwriter are required. Good credit will be required for approval as well.
Regardless of the amount of the injunction required, our agency will need the following from you:
- A copy of the Court document ordering an injunction surety bond. Typically, the order for a bond occurs at the very end of the document. This Order also provides our agency with other information needed to provide an acceptable surety bond;
- A completed, signed and witnessed surety bond application;
- Review by an underwriter for amounts greater than $25,000;
- Upon approval of your application, payment of at least the first annual premium.
Once your surety bond is approved, and the premium paid, our agency issues your bond to you immediately.
We will sign your original surety bond as Surety; upon receipt, you’ll sign your bond as Principal.
It will be your responsibility to file your bond with the Court.
Annual Renewal of the Premium
The premium associated with your Michigan injunction bond renews annually for as long as the Court requires surety; it is not a onetime payment.
We typically advise our customers to prepare to pay the premium at least twice — once, upon the issuance of your injunction surety bond, and one year later.
