Surety Bond; Purpose




A Michigan temporary restraining order bond is a surety bond that is required as a prerequisite to obtaining an injunction in a civil litigation proceeding.

While the bond is required of the Plaintiff, its benefit is for the Defendant(s).

This surety bond is required as a financial guarantee that should the court subsequently determine that the temporary restraining order (TRO) was wrongly issued, the surety bond can be used as financial recompense for the harm caused to the Defendant(s) as a result of the restraining order.

If the Court has ordered you (or for legal counsel, your Plaintiff-client) to obtain a TRO surety bond, the temporary restraining order is predicated on you obtaining surety, and filing it with the Court within the timeframe the Court directs (Michigan Court Rules 3.310, (D)(4).




Qualifying and the Premium




Our agency can provide you with the Michigan temporary restraining order in whatever amount ordered of you (or of the Plaintiff) by the Court.

And up to, and inclusive of a $25,000 surety bond requirement, we also do so without a credit check inquiry. Amounts greater than $25,000, require a credit inquiry --- and good credit --- for approval.

Regardless of the amount of your Court order, our agency will need the following from you:

  • A copy of the Court Order which provides us with the surety bond requirement. This order also provides us with additional information which also appears on your surety bond;
  • A completed, signed, and witnessed surety bond application;
  • * If the surety bond is greater than $25,000, review and approval by our Surety underwriter;
  • * Payment of at least the first year premium.

Upon approval of your Michigan TRO bond and payment of the premium, our agency issues your bond to you for filing.

Our agency signs your bond as Surety; upon receipt, you’ll sign your TRO bond as Principal. It will be up to you to file your bond and related court documents (usually, just the Power of Attorney form).




Annual Renewal of the Premium




The premium associated with your Michigan TRO surety bond renews annually on the anniversary of the bond’s issuance.

Your TRO surety is active for as long as the Court requires surety.

In our experience, it’s always a good idea to prepare to pay the premium at least twice: First, when the TRO bond is initially issued, and then 1 year later.
