Surety Bond of Guardians; Amount and Purpose
As a conservator/guardian for a Mississippi resident, you are conditionally appointed over the estate of either a minor, or an incapaciated adult.
One of the conditions of your court appointment is that you submit evidence of obtaining a surety bond in the amount that the court has ordered.
According to the Mississippi Code, 93-13-17, as amended, the amount of the surety bond will be in an amount as determined by the court.
In the practical order, that amount is likely to be commensurate with the value of the estate over which you’ll have direct and immediate control.
The surety bond serves as a financial guarantee that you’ll comply with conservator/guardian Mississippi laws in the administration of the estate.
Qualifying and the Premium
Our agency typically qualifies you and approves you for the Mississippi guardian bond up to a $100,000 surety bond requirement without a credit check.
If you require a conservator/guardian bond greater than $100,000, approval is subject to review of your credit — good credit is required — and providing any additional documentation or information requested by our surety bond underwriter.
For any guardian/conservator bond, our agency will need the following from you:
- A copy of the court order appointing you Mississippi guardian or conservator. The order will also need to state the surety bond amount required;
- A completed surety bond application. This application is offered to you via DocuSign. DocuSign will allow you to complete, sign, and return your application electronically;
- Upon review and approval of your application, payment of the first annual premium.
Your surety bond is issued to you immediately upon payment of the premium. Included with your surety bond will be a Power of Attorney form. Upon receipt by mail, you’ll sign your bond and then file both items with the presiding Mississippi probate court.
Annual Renewal of the Premium
The premium associated with your guardian bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are nonrefundable.
