Surety Bond; Purpose
A temporary restraining order bond (TRO) is an injunction bond required in a civil litigation proceeding. The bond is required of the Plaintiff, by order of a Court, on behalf of a Defendant(s).
Typically, when a TRO is ordered by the court, the procedure is conducted “ex parte”, which is just a Latin phrase which means that the TRO and order to obtain a surety bond are done outside of the presence of the adverse party (i.e. the Defendants).
As such, an order of injunction, or temporary restraining order, restrains the Defendant(s) from acting in a certain capacity. The surety bond requirement is a condition for the issuance temporary restraining, otherwise no order TRO is issued.
The surety bond, therefore, is for the protection of the Defendant(s) in case the court subsequently determines that no TRO should have been issued. In light of this subsequent finding, if applicable, the Defendant may be compensated by means of the TRO bond for loss of earnings, and the payment of costs, attorney fees, and related charges.
Qualifying and the Premium
Our agency offers the Mississippi temporary restraining order in the amount required by the Court; and up to a $25,000 surety requirement, we also do so without a credit check inquiry.
Amounts greater than $25,000 are subject to a review by an underwriter. This review includes a credit check inquiry. To be approved, good credit is required.
Regardless of your surety bond requirement, our agency will need the following from you:
- A copy of the court order that states that a temporary restraining order is required. Besides providing us with the amount of surety required, the order has many other details needed for correct issuance of your bond;
- A signed and completed surety bond application. The application is fairly short, and is required whether or not you need approval based on credit, or if the bond is at the $25,000 or below threshold;
- Payment of at least the first annual premium.
After approval of your MS TRO surety bond and payment of the premium, our agency issues your bond to you immediately for filing.
We will sign your bond as Surety; upon receipt by mail it will be up to you to sign your bond as Principal, and then file your bond with the presiding court.
Included with your surety bond will be a Power of Attorney form.
Annual Renewal of the Premium
The premium associated with your Mississippi TRO bond renews annually on the anniversary of its issuance for as long as the Court requires surety.
We advise you to prepare to likely pay your premium at least twice: Once on the initial issuance of your bond, and one year later.
Options exist to allow you to prepay your premium for 2 or 3 years; however, bear in mind that premiums paid are earned in full.
