Surety Bond; Amount and Purpose
As a condition of your court-appointment as a Missouri conservator/guardian, you may be required to obtain a surety bond in an amount that the court orders.
As a conservator or guardian, you are appointed to oversee and manage the affairs of a minor or an incapacitated adult.
According to Missouri Revised Statutes, §475.100, as amended, for a conservator, no specific amount of surety bond is required; however, the amount will be fixed as the court directs.
If you are appointed as a guardian, however, then the amount of surety required will be, according to Missouri Revised Statutes 475.420, no less than the value of the personal property of the estate plus the anticipated income the estate is projected to earn within the upcoming year; this latter if applicable.
The surety bond serves as a financial guarantee of your compliance with all Missouri state laws in the administration of an estate as conservator or guardian.
While the Missouri probate court may have distinctions between conservator or guardian, for purposes of obtaining your surety bond, the terms may be used interchangeably.
Qualifying and the Premium
Our agency offers you the Missouri conservator/guardian bond in the amount required. Up to a $100,000 surety bond requirement, we typically offer this surety bond without a credit check inquiry.
If you require a conservator/guardian surety bond amount greater than $100,000, approval is subject to review by a surety bond underwriter. Good credit and providing any additional information or documentation requested, will also be required.
For any conservator/guardian bond, our agency will need the following from you:
- A copy of the Missouri court order appointing you as conservator or guardian, and which states the surety bond amount required of you;
- A completed surety bond application. In most cases, the application can be sent to you via DocuSign. If done, this will allow you to complete, sign, and return the application to us electronically;
- Review of your application;
- Upon approval payment of the first annual premium.
Our agency issues your surety bond to you for filing by you. Included with your bond will be a Power of Attorney form. Upon receipt by mail, you’ll sign and file your surety bond and POA form with the presiding Missouri probate court.
Annual Renewal of the Premium
The premium for your conservator/guardian bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are earned in full, and are nonrefundable both in whole or in part.
