Missouri Replevin Action; Surety Bond Requirement, Amount & Purpose
An action of replevin occurs when a Plaintiff, in a civil court matter, is permitted by the court to seize and take possession of the disputed property of a Defendant, prior to a final judgment in the underlying case.
When the Missouri court grants an action of replevin, it is conditioned upon obtaining a surety bond.
According to Missouri Rule 99.06, as amended, the amount of the surety bond is twice the value of the property being seized, as ordered by the court.
While the surety bond is required of you as Plaintiff (or, for legal counsel, your client), the purpose of the surety bond is to protect the Defendant for any damages and harm caused by a replevin action which is subsequently determined to have been wrongly issued.
Qualifying and the Premium
Our agency can approve a Missouri replevin surety bond request up to $50,000 without a prior credit check. This can allow you to more quickly meet your surety requirement.
For a replevin bond greater than $50,000, your surety bond application is reviewed by a surety bond underwriter. This review will include a credit inquiry; to be approved, good credit is required. You also may or may not be asked to submit additional supporting documentation for approval.
Regardless of your replevin surety bond amount, our agency will need the following from you:
- A copy of the court order or minutes which states that a replevin surety bond is required;
- A completed surety bond application. This application may be sent to you by DocuSign which facilitates quicker completion;
- Review of your application based on the surety bond amounts discussed above;
- Upon approval of your surety bond, payment of the first annual premium.
Once your premium payment is made, our agency issues your bond to you along with a Power of Attorney form.
We will then send the bond and POA to you for both signing as Principal. It will then be up to you (or any retained legal counsel) to file the bond with the presiding court.
Annual Renewal of the Premium
The premium for your Missouri replevin bond renews annually on the anniversary of your bond’s issuance. The annual renewal of your surety bond is required for as long as the presiding court requires surety.
