MT Conservator Surety Bond; Purpose
A guardianship bond is also referred to as a Montana conservator bond. The court-ordered surety bond may be required of someone who has charge over a minor, or someone who is in some capacity incapacitated. In Montana, a conservator may also be called a Temporary Conservator.
Montana statute 72-5-411, as amended, may require a surety bond to protect the financial interests of the person for whom you are guardian/conservator, and also to satisfy the interests of the court.
The purpose of the bond, while required of you a conservator, is to protect the property, monetary holding, and finances of the minor or incapacitated person over whom you have been appointed.
Qualifying and the Premium
Our agency offers you the Montana guardian bond in whatever amount that the court orders. Up to and inclusive of a $100,000 surety bond amount, we also do so without a credit check.
Montana guardians who require a surety bond greater than $100,000 will need to submit an application which is reviewed by a surety bond underwriter.
This review includes a credit check inquiry. And, to be approved, a determination of good credit will be required to be approved above $100,000.
Regardless of your Montana conservator bond requirement, our agency will need the following from you:
- A copy of the court order that appoint you as a conservator/guardian, and which also states the bond amount required;
- A completed surety bond application. To facilitate completion of the application, we can sent the application to you via DocuSign;
- Review and approval of your guardian bond application subject to the limits discussed above;
- Upon approval of your bond, payment of the first annual premium.
Once your bond is approved and the payment received, we issue your guardian bond to you immediately. Included with your surety bond will be a Power of Attorney form.
We will sign your bond as Surety; you will sign your bond as Principal when received by mail. You will then file your bond and POA form to the presiding court.
Annual Renewal of the Guardian Bond Premium
The premium associated with your Montana guardian bond will renew annually on the anniversary of your bond’s issuance for as long as the court requires surety. Premiums paid are earned in full and no refunds, either in full or in part, are offered.
