Surety Bond; Amount and Purpose
As a condition of your appointment as a personal representative (or as an executor) of an estate in Montana, the court may require you to obtain a surety bond.
According to Montana state law, this probate surety bond may be required of you if there is an heir or creditor who has in excess of $5000 of interest in the estate.
A personal representative bond may also be statutorily required, if the will of the decedent indicates that one is necessary.
The amount of surety bond will be determined according to the court’s discretion. Typically, that amount is the value of the estate. Sometimes, any anticipated earnings the estate is projected to earn are also included.
The surety bond, while required of you as personal representative/executor, serves as a financial guarantee of your compliance with all Montana laws in the administration of the estate.
Qualifying and the Premium
Our agency offers you the Montana personal representative/executor/administrator bond in any amount required. Up to a $250,000 surety bond requirement, we also typically do so without a credit check inquiry.
If you require a personal representative bond greater than $250,000, approval is subject to further review of your surety bond application by a surety bond underwriter. This review includes a credit check.
To be approved for an amount greater than $250,000, good credit, and supplying any additional information or documentation requested is required.
For any personal representative bond, our agency will need the following from you:
- A copy of the Montana court order appointing you personal representative/executor/administrator and which states the amount of surety bond required;
- A completed surety bond application. In most cases, the application can be sent to you via DocuSign. This will allow you to complete, sign, and it to us electronically;
- Upon receipt, review and approval of your application, payment of the first annual premium.
Our agency issues your surety bond and a Power of Attorney form to you upon payment of your premium. These will then be mailed to you for both signing and filing by you with the presiding Montana probate court.
Annual Renewal of the Premium
The premium for this probate surety bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premium paid are earned in full and are not subject to refund, either in whole or in part.
