Surety Bond; Purpose




A surety bond required of a guardian in Nebraska may alternately be referred to as a Nebraska conservator bond. Both guardian and conservator refer to the fiduciary capacity that you will be acting in preserving the property and/or assets of:

  • A minor;
  • Someone who is incapacitated in some way;
  • Or a combination of the two above.

In Nebraska, a surety bond is required for assets which are $10,000 or more.

According to Nebraska statutes §6-1441, as amended, the amount of the surety bond required is:

  • The aggregate value of the property in the estate;
  • Plus one year estimated income from the estate;
  • Minus the value of securities and other assets in the account.

Ultimately, for you, the bond amount will be in the amount that the court orders.

Your surety bond is a financial guarantee for the courts and the person for whom you have been appointed that you will act in a lawful, fiduciary capacity, and as the court directs.




Qualifying and the Premium




An applicant who requires a Nebraska guardian bond for $100,000 and less may be approved without a credit check inquiry.

An applicant who requires a Nebraska conservator/guardian bond for greater than $100,000 will undergo a review by a surety bond underwriter. This review includes a credit check inquiry. To be approved, good credit is required. The underwriter may also ask you for additional information.

Regardless of your surety bond requirement, our agency will need the following from you:

  • A copy of the court order that states the surety bond requirement. This is the first thing needed and demonstrates to our agency the need for a surety bond;
  • A completed surety bond application. The application can be provided to you via DocuSign to facilitate ease of completion;
  • Payment of at least the first annual premium subject to the approval either immediately or by a surety bond underwriter as discussed above.

Once your conservator bond is approved, our agency issues it to you immediately. We will sign your bond and provide you a Power of Attorney form.

You will sign your bond as well and then you’ll file it with the POA to the respective court office.




Annual Renewal of the Premium




The premium associated with your Nebraska guardian bond renews annually on the anniversary of its issuance for as long as the court requires surety.

Premiums paid are earned in full, and no refund, either in full or in part, is offered.
