Surety Bond; Amount and Purpose
As a condition of your appointment as a Nebraska personal representative/administrator (or executor), you may be required to obtain a surety bond.
According to Nebraska Revised Statute 30-2447, as amended, the amount of surety required will be according to the estimated value of the personal property in the estate, and the projected income the estate is expected to earn within the next year.
Ultimately, the presiding probate judge will determine the amount required of you.
The personal administrator surety bond serves as a financial guarantee of your compliance with all Nebraska laws in the administration of the estate of the decedent.
Qualifying and the Premium
The Nebraska personal representative bond is offered to you in any amount that the court requires. Up to a $250,000 surety bond requirement, we also do so without a credit check.
If you require an amount greater than $250,000, approval is subject to a review by a surety bond underwriter. This review will include a credit check. To be approved, good credit will be required.
For these higher amounts, you may also be requested to provide additional information or documentation in order to obtain approval.
But for any personal representative surety bond, our agency will need the following from you:
- A copy of the Nebraska court order stating appointing you as personal representative/executor/administrator, and which states the surety bond amount required;
- A completed surety bond application. This is normally accomplished via DocuSign which will allow you to complete, sign, and return the application to us electronically;
- Review of your completed probate surety bond application;
- Upon approval of your application, payment of the first annual premium.
Issuing Your Surety Bond; Annual Renewal of the Premium
Your personal representative bond is issued to you immediately upon payment of the premium. Included with your surety bond will be a Power of Attorney form. These items will be mailed to you.
You will sign your surety bond, and then file it along with the POA from to the presiding probate court.
The premium associated with your surety bond renews annually on the anniversary of your bond’s issuance. Premiums paid are earned in full and are nonrefundable either in whole or in part.
