Surety Bond of NY Guardians; Purpose
A New York guardian is also known as a conservator. Both designations may refer to one of the following:
- A New York guardian of an incapacitated adult;
- A guardian of a minor;
- Or a combination of the above.
A condition of your appointment as guardian is that the court requires you to obtain a surety bond. While required of you, the surety bond protects the person over whom you’ve been appointed and serves as a financial guarantee of your compliance with all related laws and court directives.
According to Section 81.25 of the New York State Senate, as amended, the amount of surety bond required of you may be the value of the estate less certain exceptions.
And, according to Section 2.3 of the New York Manual for Family Guardians, a guardianship commission is conditioned upon appointment of procuring the surety bond required in a timely manner.
Qualifying and the Premium
Our agency can qualify you for the New York guardian bond in whatever amount required. Up to a $100,000 surety bond requirement, we may also do so without a credit check.
A New York conservator (guardian) surety bond greater than $100,000 will require a review of your surety bond application by an underwriter. This review will include a credit check inquiry. To be approved for an amount above $100,000, good credit will be required.
Additionally, for these larger amounts, the surety underwriters may request supporting information.
Regardless of the amount of your surety bond, our agency will need the following from you:
- A copy of the court order or minutes which appoints you guardian and conservator and which also states the surety bond requirement;
- A completed surety bond application, to be reviewed according to the amounts above. The application can be sent to you via DocuSign to facilitate ease and timeliness of completion;
- Upon approval of your NY guardian surety bond request, payment of at least the first annual premium.
Issuing Your Guardian Bond
Our agency issues your New York guardian bond to you immediately upon receipt of the premium. We will send your surety bond and a Power of Attorney form to you by mail.
Upon receipt, you’ll sign your bond as Principal. It will then be up to you to file your surety bond and POA form with the court.
Annual Renewal of the Premium
The premium associated with your conservator/guardian surety bond renews annually on the anniversary of its issuance for as long as the court requires surety.
Premiums paid are earned in full. There is no refunding, in full or in part, of any premium received.
