Surety Bonds; Amount and Purpose
A court-appointed personal representative over an estate that is not to subject to an informal probate proceeding, may be required to file evidence of an appropriate personal representative surety bond.
Your probate surety bond serves as a financial guarantee of your compliance with all North Dakota laws and regulations governing the administration of an estate that is in probate.
According to current North Dakota statutes, the amount of the surety bond required will be equivalent to the total value of the estate, plus any amount the estate is projected to earn within the next year.
Qualifying and the Premium
Our agency offers you the North Dakota personal representative bond (in some cases, this bond may also be referred to as a probate surety bond of an administrator or executor) in any amount.
Up to a $250,000 surety bond requirement, we also typically provide this bond without a credit check.
If you require an amount greater than $250,000, approval is subject to review by a surety bond underwriter. This review will include a credit check inquiry.
To be approved at an amount greater than $250,000, besides a determination of good credit, you may also be required to provide supporting documentation or information.
For any amount of your personal representative bond, our agency will need the following from you:
- A copy of the North Dakota court order appointing you personal representative/administrator/executor and which states the amount of the surety bond required from you;
- A completed surety bond application. Our agency usually provides this application to you via DocuSign. This will allow you to complete, sign, and return the application to us electronically;
- Review of your surety bond application;
- Upon approval of your application, payment of the premium.
Our agency issues your surety bond and a Power of Attorney form to you immediately after the first premium payment is made.
These are then mailed to you for signing. You will file the completed surety bond and POA form with the presiding ND probate court.
Annual Renewal of Your Premium
The premium for your North Dakota personal representative bond renews annually on the anniversary of your bond’s issuance for as long as the probate court requires surety.
Premiums paid are earned in full and are nonrefundable either in part or in entirely.
