Surety Bond; Purpose and Amount
An Ohio attachment order allows you, the plaintiff, to seize and take possession of the disputed property of the defendant, prejudgment.
A condition for the order to take effect is that you obtain an attachment surety bond in the amount ordered by the court.
According to Ohio’s statute, Section 2715.48, as amended, the amount of the attachment surety bond should be double the value of the property being seized. The court, however, will determine the exact amount required.
While required of you, the attachment bond is for the benefit of the adverse party in case the court subsequently determines that the attachment order was wrongly issued.
The harm having occurred in a determination of wrongful attachment, the adverse party is able to be recompensed for a wrongly issued attachment order.
You may hear the terms: ‘writ of attachment bond’ or ‘plaintiff’s attachment bond’. Know that these terms mean the same thing and can therefore be used interchangeably.
Qualifying and the Premium
Our agency offers you the Ohio attachment bond in the amount that the court requires of you (minimum amounts may apply).
Up to a $100,000 surety bond amount, we also do so without a credit check.
An Ohio attachment bond greater than $100,000 is subject to an underwriter review of your surety bond application. This review will include a credit check inquiry. To be approved, good credit is required.
If you have an attachment bond greater than $100,000, you may also be requested to provide supporting information or documentation as a condition of approval.
For any attachment bond, our agency will need the following from you:
- A copy of the Ohio attachment order stating the surety bond requirement;
- A completed surety bond application. The application will usually be sent to you via Docusign. This will allow you to complete, sign, and return the application to our agency electronically;
- Review of your completed application;
- Upon approval, payment of the premium.
Issuing Your Bond
Our agency issues your Ohio attachment bond to you immediately upon payment of the first annual premium. The original documents are then mailed to you.
Included with your attachment bond will be a Power of Attorney form. Both of these items are filed by you to the presiding Ohio court.
You’ll need to sign your bond as Principal before filing.
Annual Renewal of the Premium
The premium associated with the Ohio attachment bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are earned in full and are completely nonrefundable.
