Ohio Probate Surety Bond; Purpose And Amount




Probate is broadly defined as the process of proving a will. The surety bond associated with the probate process may also be required of someone appointed to act as a Guardian or Conservator.

As a person who is required to obtain a probate bond, your position may be titled:

  • A personal representative;
  • An administrator or executor;
  • A trustee;
  • Or, as listed above, a guardian or conservator.

The surety bond is required as a financial guarantee that you will act in a disinterested, lawful capacity, and in the manner in which the court directs.

According to the Ohio Revised Code, 2109.04, as amended, the amount of surety required of you will be:

  • No less than double amount of the property and of the annual rentals that will come into your possession as fiduciary;
  • And in an amount that the court decides.




Qualifying and the Premium




Our agency offers you the Ohio probate bond in any amount required. Up to a $250,000 requirement, we also offer this probate bond without a credit check inquiry. The same is likewise true of a probate bond required of guardians or conservators, but up to $100,000.

For both categories, a surety bond requirement greater than these amounts will be conditioned upon approval of good credit and other criteria as may be requested.

Regardless of your bond requirement, our agency will typically need the following from you:

  • A copy of the court order or minutes stating that a probate surety bond is required. This order will provide us with practically all of the information needed to complete your bond (i.e. name of the estate, court venue, etc.);
  • A completed application. Applicants who have a surety bond requirement above the thresholds discussed above will have their applications reviewed by an underwriter. To facilitate completing the application, we can send it to you via DocuSign;
  • Upon approval of your bond, payment of at least the first annual premium. Premiums paid are earned in full.

After approval of your Ohio probate bond and payment of the premium, our agency issues your bond to you immediately for filing. We will sign your bond as Surety, and upon receipt by mail, you’ll sign your bond as Principal.

It will be up to you (or legal counsel) to file your bond with the appropriate clerk of the court.




Annual Renewal of the Premium




The premium associated with your Ohio probate bond renews annually on the anniversary of your bond’s issuance for as long as the presiding court requires surety.

Premium paid are earned in full and no refund, either in full or prorated, is offered.
