Surety Bond; Purpose

 

 

 

An Oregon replevin bond is a court ordered surety bond which allows a Plaintiff in a civil litigation proceeding to seize the disputed property of a Defendant, prior to a judgement in the underlying case.

As a condition for obtaining the action of replevin (sometimes also referred to as a writ of attachment) you must obtain a surety bond in the amount that the court orders.

While required of you as Plaintiff, the bond is for the benefit of the Defendant in case the court subsequently determines that the action of replevin was wrongly issued. In such a determination, the surety bond offers a financial guarantee of the timely return of the property seized, and payment for any loss and harm caused due to the replevin action.

Chapter 29 of the Oregon Revised Statutes is the legislation which deals with an attachment/replevin surety bond requirement.

 

 

 

Qualifying and the Premium

 

 

 

Our agency qualifies you for the replevin surety bond in the amount that you require largely based upon the amount of the surety bond.

If you require a surety bond $50,000 and less, we typically provide this bond to you without a credit check inquiry.  If you require a replevin bond greater than $50,000, qualifying is based upon a surety bond review of your application, along with a credit check inquiry.  

To be approved, good credit will be required for an amount greater than $50,000 by our agency.  Additionally, supporting information is sometimes requested by an underwriter for approval. 

All replevin surety bonds issued by our agency will need the following:

  • A copy of the court order or the court minutes stating that a replevin surety bond is required; 
  • A completed surety bond application.  The application can be sent to you via DocuSign;
  • Review of your application, subject, in part to the dollar amount of the replevin surety bond required as discussed above;
  • Upon approval of your surety bond, payment of the first annual premium.

Upon payment of the Oregon replevin surety bond premium, our agency issues your bond to you for filing.  We will send your surety bond and a Power of Attorney to you for filing.  

Upon receipt by mail, you’ll both sign your surety bond and file it along with the POA form to the presiding court.

 

 

 

Annual Renewal of the Premium

 

 

 

The premium associated with your replevin surety bond renews annually on the anniversary of your surety bond’s issuance for as long as the court requires surety.

Premiums paid are earned in full and non-refundable either in part or entirely.
