Surety Bond; Purpose and Amount
As an court appointee of an estate of someone who is either a minor, or an adult who is incapacitated, a recent court appearance may have resulted in the neeed for a surety bond.
Your Pennsylvania court-appointment as guardian/conservator is conditioned upon procurement of the guardianship surety bond.
The amount of your guardian bond will be determined by the presiding PA court. Our experience has been that the amount required will at least include the assets over which you’ll have direct control.
Although Pennsylvania may have legal distinctions between the term “guardian” or “conservator”, as far as qualifying and having this bond issued, our agency uses these interchangeably.
Qualifying and the Premium
Our agency offers you the Pennsylvania conservator/guardian bond up to a $100,000 requirement, typically, without a prior credit check qualification.
If you require this surety bond for an amount greater than $100,000, approval is subject to further review of your application by a surety bond underwriter. This review will include a credit check inquiry, and providing any requested documentation or information.
Approval at an amount greater than $100,000 will also require good credit.
The issuing process for your Pennsylvania guardianship bond follows this general pattern:
- Our agency will need a copy of the Pennsylvania court order appointing you guardian/conservator, and which also states the amount of surety bond required;
- An application will be sent to you for completing. This is usually, though not always, via DocuSign. DocuSign will allow you to sign, complete, and return the application to our agency;
- Upon review and approval of your guardian bond application, using the dollar limits above, payment of the first annual premium.
Issuing Your Surety Bond
Your guardian surety bond and a Power of Attorney form are issued and then mailed to you immediately after payment of at least the first annual premium.
Upon receipt in the mail, you’ll sign your bond as Principal and file both items received with the PA probate court.
Annual Renewal of the Premium
The premium for your guardian/conservator bond is not just once-only payment. The premium renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are earned in full and are not refunded either in whole or in part.
