Replevin Action; Surety Bond And Amount

 

 

 

A replevin action occurs in a civil litigation proceeding.  By means of a court order, the Plaintiff is permitted to seize the disputed property of the Defendant  prior to a judgement being given in the underlying case.

In the Commonwealth, according to Rule 1075.3 Writ of Seizure. Bond, the amount of surety required is twice the value of the property being seized.  A surety bond is required before the action of replevin takes place.

The same statute provides the purpose of the surety bond requirement:  While required of the Plaintiff, the surety bond is for the benefit of the Defendant in case the latter party is subsequently determined to have been wrongfully replevined.   

 

 

 

Qualifying and the Premium

 

 

 

Qualifying for a Pennsylvania replevin bond with our agency is typically done in one of two ways.

If you require a replevin bond for $50,000 or less, we can approve you without a credit inquiry; and for more than $50,000, upon review of your surety bond application.  

For a replevin bond greater than $50,000, good credit will be required for removal. You may also be asked to provide additional information.  

For any replevin surety bond, our agency will need all of the following from you:

  • A copy of the court order stating that a replevin bond is required.  This order will provide our agency with all that will be needed to be included on your surety bond;
  • A completed surety bond application which can be sent to you via DocuSign;
  • Review of your surety bond application by a surety bond underwriter, subject to the amounts above;
  • Upon approval of your surety bond, payment of the first annual premium.

 

 

Issuing Your Surety Bond

 

 

 

Upon approval of your replevin surety bond and payment of the first annual premium, our agency issues and sends you all surety bond documents for signing.  You will then file the signed surety bond and Power of Attorney form with the presiding court.

Annual Renewal of the Premium

The premium for your replevin surety bond renews annually for as long as the court requires surety.

Premiums paid are earned in full and are nonrefundable.
