Surety Bond; Purpose and Amount


As Plaintiff in a civil court matter, the court may agree that you are likely to prevail in the final outcome of your litigation proceedings.

Accordingly, according to Rhode Island Rule 4, (3), Writ of Attachment, Issuance, an attachment surety bond may be required of you.

Your Rhode Island writ of attachment bond allows you to seize, pre-judgment, the defined property of the adverse party (that is, the Defendant).

Although the writ of attachment surety bond is required of you as Plaintiff, it is a financial guarantee for the benefit of the Defendant in case the court subsequently determines that the attachment was wrongly issued.

The attachment surety bond, therefore, serves as a financial guarantee that the adverse party can be compensated for the loss or harm caused by a wrongly issued attachment.

To be clear, the term ‘writ of attachment’ is synonymous with an ‘attachment bond, ’‘plaintiff’s attachment bond,’ or ‘plaintiff’s writ of attachment bond’.


Qualifying and the Premium


Our agency offers you the Rhode Island writ of attachment bond up to a $100,000 surety bond requirement, typically without a credit check inquiry.

If you require an attachment surety bond greater than $100,000, your application is further reviewed by a surety bond underwriter.  This review will include a credit check inquiry.

To be approved for an amount greater than $100,000, good credit is required.  You may also be asked to provide supporting information or documentation as a condition of your approval.

For any Rhode island writ of attachment surety bond, our agency will need the following from you:

  • A copy of the Rhode Island court order which states that an attachment surety bond is required;
  • A completed surety bond application.  The application can be completed via Docusign.  Docusign will allow you the convenience of completing, signing, and returning the application to our agency electronically;
  • Upon approval of your application, payment of the premium. 


Issuing Your Attachment Bond


Our agency issues you your RI attachment bond along with a Power of Attorney form, upon payment of the premium.

These items will be mailed to you (or legal counsel, as you prefer).  Before filing these items, as Plaintiff you’ll, need to sign your surety bond first.

Premium Payments

Premiums paid for this bond are nonrefundable, both in part and in whole.  Your premium may renew annually on the anniversary of your bond's issuance for as long as the presiding court requires surety.  It is your responsibility to inform our agency when your court has exonerated your attachment bond (meaning, it is no longer required).
