Surety Bond; Amount and Purpose




An action of replevin, or a writ of attachment, is a court order which allows a Plaintiff to seize the disputed property of a Defendant, prior to a final judgment being rendered in the underlying civil case.

The replevin action takes effect only after a surety bond is obtained by the Plaintiff in the amount ordered by the presiding court.  Current South Carolina statutes, under Action and Claim of Delivery, #9, indicates that the amount of surety required is twice the value of the personal property stated in the affidavit.

While required of you as Plaintiff (or, for legal counsel, your client), the replevin surety bond is a financial guarantee that should the court subsequently determine that the replevin action was wrongly issued, you will return the seized property to the Defendant as ordered.




Qualifying and the Premium




Our agency offers you the South Carolina replevin bond in the amount that the court requires of you.  

If you require a replevin surety bond that is $50,000 or less, we’ll typically approve you without a credit inquiry.  

If you require a replevin surety bond greater than $50,000, approval is based on a surety bond underwriter review of your application, good credit, and providing any additional underwriting information as may be requested.

The following are the items we’ll need to get your replevin surety bond issued:

  • A copy of the court order or a copy of the court minutes stating that a replevin surety bond is required;
  • A completed surety bond application.  The application may be sent to you via DocuSign to facilitate ease of completion;
  • Review of the completed surety bond application subject to the dollar amounts discussed above;
  • Upon approval of your application, payment of the first annual premium.



Issuing Your Replevin Bond




Your SC repelvin surety bond is issued to you immediately upon payment of the first annual premium.  Included with your surety bond will be a Power of Attorney form.

Upon receipt by mail, you’ll sign your surety bond as Principal, and you file your bond along with the POA form to the presiding South Carolina civil court.




Annual Renewal of Your Surety Bond Premium




The premium for the replevin surety bond is non-refundable and renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
