Surety Bond; Purpose
As guardian or conservator, you are a court-appointed overseer over the well-being of either a minor or an adult who is incapacitated.
A condition of your guardianship appointment is that you obtain a surety bond in the amount required by the South Dakota probate court.
According to South Dakota state law, 29-5-111, as amended, the amount of the surety bond will be determined by the value of the estate and the amount of money that is in your control; and other factors as listed within the same statute.
The court will, if they have not already, inform you of the amount of surety required. The surety bond required of you may alternately be referred to as a South Dakota conservator bond.
Qualifying and the Premium
Our agency can qualify you for the South Dakota guardian bond up to a $100,000 surety bond requirement without a credit check.
A conservator/guardian surety bond greater than $100,000 requires a review of your surety bond application by an underwriter, good credit, and supplying any additional information requested to our underwriters.
For any conservator/guardian bond, our agency will need the following from you:
- A copy of the court order stating that you require a surety bond;
- A completed surety bond application. The application can be sent to you via DocuSign to facilitate ease of completing;
- Review of your surety bond application, in part, according to the dollar threshold above;
- Upon approval of your surety bond application, payment of the first annual premium.
Upon payment of the first annual premium, we issue your surety bond and a Power of Attorney form to you. You will both sign your surety bond and file it, along with the POA to the presiding court.
Annual Renewal of the Premium
The premium associated with your South Dakota guardian bond renews annually on the anniversary of your bond’s issuance for as long as the court requires surety.
Premiums paid are earned in full and are nonrefundable.
