Replevin Surety; Purpose
A replevin surety bond is required of a Plaintiff in a civil litigation proceeding. By order of the court, the Plaintiff is allowed to both seize and take possession of the disputed property of the adverse party (that is, the Defendant).
As a condition of obtaining an action of replevin, you are required to furnish evidence of a surety bond in the amount that the court orders.
While required of you as Plaintiff (or, for legal counsel, your client) this surety bond is for the benefit of the Defendant in case the court later determines that the replevin action was wrongly issued.
The replevin surety bond serves as a financial guarantee that you will return the seized property in a timely manner, if so ordered; and, moreover, that the Defendant can be compensated for the loss and harm due to a wrongly issued replevin action.
Qualifying and the Premium
Our agency offers you the South Dakota replevin bond up to a $50,000 requirement, typically without a credit check inquiry.
If you require a replevin surety bond greater than $50,000, approval is after review of your surety bond application by an underwriter; proof of good credit; and providing any additional information requested.
Here’s what else we’ll need to get your replevin bond issued:
- A copy of the court order stating that the replevin bond is required;
- A completed surety bond application. The application can be sent to you via DocuSign to facilitate completing;
- A review of your completed surety bond application, subject, in part, to the dollar limits discussed above;
- Upon approval of your surety bond, payment of the first annual premium.
Our agency issues your replevin surety bond to you for both signing and filing upon payment of the premium. Included with your surety bond will be a Power of Attorney. You will file both documents with the presiding court.
Annual Renewal of the Premium
The premiums for your replevin surety bond renews annually on the anniversary of your surety bond’s issuance for as long as the court requires surety.
Premium paid are earned in full and are non-refundable, both in entirety or in part.
