Surety Bond; Amount and Purpose
An action of replevin takes place in a civil litigation proceeding. By order of the presiding court, the Plaintiff is permitted to seize and take possession of the disputed property of the Defendant, prior to a final judgment being given in the underlying case.
A condition for the replevin action (also known as a writ of attachment) is that you, as Plaintiff, obtain a surety bond.
According to Tennessee statute 29-30-106, as amended, the amount of surety required is no less than the value of the property in question. However, the court will define the exact amount of bond required.
While required of you, the purpose of this surety bond is for the benefit of the Defendant in case the replevin action is later determined to have been wrongly issued.
In such a determination, the surety bond would guarantee the return of the property and any payment for the loss or harm caused by the issuance of the replevin action.
Qualifying and the Premium
We provide the Tennessee replevin bond up to a $50,000 surety bond requirement without a credit check, in most instances.
If you require a surety bond greater than $50,000, approval is granted after a surety bond underwriter review of your surety application and determination of good, solid credit. Additionally, the surety bond underwriter may require additional information as needed.
Regardless of the amount of your surety bond, our agency will need the following from you:
- A copy of the court order stating that a replevin surety bond is required;
- A completed surety bond application. To facilitate ease of completion, the application may be sent to you via DocuSign;
- Review of the completed application, subject to the dollar thresholds discussed above;
- Upon approval of your surety bond, payment of the first annual premium.
Once your replevin surety bond is approved and the premium is paid, our agency issues your bond and a Power of Attorney to you for both signing and filing with the court by you.
Annual Renewal of the Premium
The premium for your TN replevin bond renews annually on the anniversary of your surety bond’s issuance for as long as the court requires surety.
Premiums paid are earned in full and are non-refundable, either in whole or in part.
